Applicants based in Gujarat fall under the jurisdiction of the Patent Office branch in Mumbai. Applications are filed online, and hearings before the Controller are generally held by video conference. A Surat applicant does not ordinarily need to travel to Mumbai at any stage.
Patentable inventions often arise in:
Not every innovation calls for a patent. A new fabric print or the shape of a product is often better protected as a registered design, and a brand by a trademark. Some process improvements are better kept as trade secrets. We advise on the right form of protection before anything is filed.
Small entities (generally MSMEs, with supporting evidence such as Udyam registration) and DPIIT-recognised start-ups pay about one-fifth of the official fees paid by larger companies. For electronic filing, the official fee for an application is ₹1,600 against ₹8,000. Both categories can also request expedited examination.
The application is published 18 months from the priority date. A request for examination must be filed within 31 months. After grant, renewal fees fall due each year from the third year, and a statement of working is filed once every three financial years. Keep the invention confidential until the application is on file.
Do I need to visit the Patent Office in Mumbai?
No. Applications and responses are filed online, and hearings are generally held by video conference.
Is my textile process patentable?
A process can be patented if it is new, involves an inventive step and has industrial application. Minor changes to a known process may not qualify. A new print or fabric pattern is usually better protected as a registered design.
Can an MSME get reduced fees?
Yes. An MSME that qualifies as a small entity pays reduced official fees, supported by evidence such as Udyam registration.
Do I need a working prototype?
No. The application must describe the invention clearly enough for a skilled person to carry it out, but a prototype is not required.
Who owns an invention made by an employee?
It depends on the employment terms. A written assignment from the inventor to the company should be in place before filing.
Should I also register a design or trademark?
Often, yes. A patent protects how a product works. A design registration protects how it looks, and a trademark protects the brand. See Trademark Registration in Surat.
